New Regulation for Exit Authorizations for Minors to Leave the Country: Legal Security and Protection of Rights

On September 4, 2025, the Plenary Session of the Council of the Judiciary issued Resolution No. 063-2025, by means of which it approved the Regulation for processing authorizations for the exit of children and adolescents from the country through the notarial service at the national level. This regulation represents a milestone in the protection of the rights of children and adolescents, reinforcing legal certainty in procedures of high social and family sensitivity.

The new regulation seeks to ensure that every authorization for the exit of minors is carried out under strict parameters of legality, transparency and control, with particular emphasis on the best interests of the child. It establishes that parents or legal representatives must mandatorily submit the official forms issued by the Council of the Judiciary, together with the supporting documentation proving identity, kinship, and legal standing.

The notarial procedure includes, among other aspects, the verification of identity through national identification cards and voting certificates, the collection of fingerprints and photographs of the parties involved, as well as a direct interview with the notary, who must identify potential risks related to human trafficking, hazardous migration or identity fraud. Additionally, the regulation provides for the incorporation of enhanced security measures—such as holograms or QR codes—into notarial testimonies, in order to strengthen the authenticity of such documents.

It is important to note that the regulation prohibits remote appearances in these proceedings requiring physical presence before the notary as a safeguard mechanism. It also provides for fee exemptions in certain cases involving persons with disabilities or senior citizens, thereby reinforcing the principle of equity.

The issuance of this resolution offers citizens greater certainty in the process and imposes on notaries a heightened responsibility as guarantors of public faith. Its practical application will require continuous training, both within the notarial profession and among migration control authorities.
